Terms of Service

These terms govern your use of the FlashShift app and website (the “Service”), provided by Energycount Limited (“we”, “us”). By creating an account or using the Service, you agree to these terms. If you are using FlashShift on behalf of a business, you confirm you are authorised to accept these terms for that business.
The Service
FlashShift lets managers broadcast open shifts to their team and lets workers claim, withdraw or swap them. The first worker to accept an open shift secures it. We may improve, change or discontinue features over time.
Accounts
You sign in with your mobile phone number and a one-time code. You are responsible for keeping access to your phone and account secure, and for the activity that happens under your account. Provide accurate information and keep it up to date.
Free trial & subscriptions
- Each team gets a 30-day free trial from creation, with no card required.
- After the trial, a manager needs an active subscription to broadcast new shifts. Existing data remains accessible.
- Billing is handled on the web by Stripe. Prices are shown before you subscribe.
- If a renewal payment fails, a short grace period applies before broadcasting is paused, giving you time to update your card.
- You can cancel any time; cancellation takes effect at the end of the current paid period. Fees already paid are non-refundable except where required by law.
Acceptable use
Use the Service lawfully and only for genuine staffing within your own team. Do not misuse it, attempt to bypass security or access controls, disrupt the Service, or use it to harass others or post unlawful content. FlashShift coordinates shifts; it is not an employer and is not a party to any employment, contractor or pay arrangement between managers and workers.
Your content
You keep ownership of the information you put into the Service (such as shift details and your name). You grant us the permission needed to host and process it to operate the Service.
Availability
We work to keep the Service running reliably but provide it “as is” and cannot guarantee it will always be available, uninterrupted or error-free.
Liability
To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss arising from shifts that go unfilled, are double-handled, or are mis-scheduled. Nothing in these terms limits liability that cannot be limited by law. Where we are liable, our total liability is limited to the fees you paid us in the 12 months before the claim.
Ending your use
You can stop using the Service and delete your account at any time from Settings. We may suspend or end access if these terms are breached or to protect the Service or other users.
Changes
We may update these terms from time to time. We will update the “last updated” date and, where appropriate, notify you in the app. Continued use after changes means you accept them.
Governing law & contact
These terms are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction. Contact us at mail@energycount.co.uk.
